1. About This Service

1.1 Who We Are

Modality Learning is an adaptive learning platform operated by Modality Learning Ltd (Company Number: 17006152), a company registered in England and Wales.

1.2 What This Is

Modality Learning is an adaptive learning platform that uses AI and knowledge graphs to personalise your learning experience. The platform is provided as a software-as-a-service to educational institutions, facilitators, and learners.

1.3 Agreement

These Terms and Conditions apply to all users of Modality Learning. You agree to these terms by:
  • Creating an account and using the platform; or
  • Accessing the platform through an account provisioned by your institution (see Section 3.4)
If you don't agree, please don't use the platform.

2. Eligibility

2.1 Age Requirements

  • You must be at least 13 years old to use Modality Learning
  • If you're under 18, we recommend getting parental consent (though not legally required in the UK)
  • If you're under 13, you cannot use the platform

2.2 Access

To use Modality Learning, you must:
  • Have a valid account — either self-registered or provisioned by your institution
  • Be participating as part of an enrolled cohort or course
  • Accept that the platform uses AI to personalise your learning experience

3. Your Account

3.1 Creating an Account

  • You can sign up using either:
    • Google OAuth (we never see your Google password)
    • Username and password (securely managed by Firebase Authentication)
  • Authentication and security are handled by Firebase Authentication (Google)
  • We collect only your email address for account identification
  • You're responsible for keeping your account credentials secure
  • One account per person - no sharing

3.2 Account Security

  • Keep your login credentials confidential (whether Google account or password)
  • If using username/password: choose a strong, unique password
  • Don't share your account with others
  • Notify us immediately if you suspect unauthorised access: support@modalitylearning.ai
  • You're responsible for all activity on your account

3.3 Account Termination

  • You can stop using the platform at any time - just email us at support@modalitylearning.ai
  • We may suspend or terminate accounts that violate these terms
  • We may discontinue the service with reasonable notice (at least 30 days)

3.4 Institutionally Provisioned Accounts

If your account was created by your institution (such as a university or college) rather than by you directly:
  • Your institution has agreed to our Institutional Terms and has authorised your access to the platform
  • Your account is managed by your institution and authenticated through your institution's identity provider
  • By logging in and using the platform, you agree to these Terms and Conditions
  • Your institution controls the lifecycle of your account — when you leave your institution or are no longer enrolled in a relevant course, your institution will de-provision your account
  • To request changes to your account or raise concerns about how your account was provisioned, contact your institution in the first instance
  • Your data protection rights (Section 5.4) remain the same regardless of how your account was created — you can exercise these directly with us at any time

4. How to Use the Platform

4.1 Acceptable Use

You agree to:
  • Use the platform for learning and educational purposes only
  • Provide honest responses and engage authentically
  • Use the platform in good faith as a learning tool

4.2 What You Cannot Do

You must not:
  • Try to reverse engineer or copy the platform
  • Attempt to access other users' data or accounts
  • Use automated tools, bots, or scripts
  • Deliberately try to break or overwhelm the system
  • Game the system or cheat on assessments
  • Upload harmful, illegal, or inappropriate content
  • Misrepresent AI-generated content as entirely your own original work

4.3 Academic Integrity

  • Modality Learning is a learning aid, not a replacement for learning
  • When using platform-generated explanations or content in academic work, attribute appropriately
  • Understand the material - don't just copy AI-generated content

5. What Data We Collect and Why

5.1 What We Collect

We collect:
  • Your email address (required for account creation)
  • Authentication data (securely managed by Firebase - we never see plain-text passwords)
  • Learning progress: which modules you're enrolled in, topics you've completed, your progress through materials
  • Interaction data: how you engage with content, your responses to questions, explanations you provide, time spent on activities
  • Performance data: assessment scores, coverage scores (understanding), stability scores (memory retention)

5.2 Why We Collect It

We use this data to:
  • Provide you with the learning platform
  • Track your progress through courses
  • Personalise your learning experience (recommend next topics, schedule reviews)
  • Improve our cognitive modelling and adaptive algorithms
  • Conduct research on effective learning methods (using anonymised data)

5.3 Automated Decisions

Our platform makes automated decisions about:
  • What content to show you next (recommendations based on your progress)
  • When to schedule review sessions (spaced repetition algorithm)
  • How difficult content should be (adaptive difficulty)
You have the right to human review of these decisions - contact your facilitator or us at support@modalitylearning.ai if you have concerns.

5.4 Your Privacy Rights

For full details on how we handle your data, see our Privacy Notice.
You have the right to:
  • Access your data (request a copy)
  • Correct inaccurate data
  • Delete your data
  • Object to processing
  • Withdraw consent at any time
  • Complain to the ICO (UK data protection authority)
These rights apply regardless of whether you created your own account or your institution provisioned it for you.

6. Ownership and Intellectual Property

6.1 Platform Ownership

Modality Learning Ltd owns:
  • The Modality Learning platform, code, and algorithms
  • The knowledge graph structure and system architecture
  • AI-generated content and explanations
  • Analytics and insights derived from aggregated data

6.2 Your Content

  • You retain ownership of original work you create (your explanations, answers, etc.)
  • By using the platform, you grant us a licence to:
    • Store and display your content
    • Use it to operate and improve the platform
    • Analyse it (anonymised) to improve our algorithms
  • This licence ends when you delete your account

6.3 Facilitator Content

  • Course facilitators own their knowledge graphs and course materials
  • By enrolling in a course, you receive a licence to access those materials for learning purposes only
  • You cannot redistribute or commercially use facilitator content

6.4 AI-Generated Content

  • Content generated by our AI is provided "as is"
  • While we strive for accuracy, AI can make mistakes
  • Always verify important information - don't rely solely on AI-generated content for critical decisions
  • AI content is a learning tool, not a definitive reference

7. Service Availability and Disclaimers

7.1 Service Availability

We aim to provide a reliable service, but:
  • No guarantee of uptime - the platform may experience occasional downtime for maintenance or unforeseen issues
  • No guarantee of accuracy - AI-generated content may contain errors
  • Features may change - we continuously improve the platform and features may be added, modified, or removed

7.2 Learning Outcomes

We cannot and do not guarantee:
  • That you will learn faster or better than with traditional methods
  • Specific grades, test scores, or academic achievements
  • That the platform will work for your specific learning style
  • That completing platform content equals mastery of a subject
Your results depend on your effort, engagement, and how you use the platform.

7.3 Support

  • Support is available via support@modalitylearning.ai
  • We will make reasonable efforts to respond to support requests in a timely manner
  • Critical issues affecting platform availability will be prioritised

8. Limitation of Liability

8.1 What We're Not Liable For

To the fullest extent permitted by law, Modality Learning Ltd is not liable for:
  • Any indirect, consequential, or incidental damages
  • Loss of data, grades, or learning opportunities
  • Academic performance or outcomes
  • Platform downtime or interruptions
  • Errors in AI-generated content
  • Any losses resulting from use of the platform

8.2 Maximum Liability

Where you have paid fees directly to Modality Learning Ltd, our maximum aggregate liability to you for any claims arising out of or relating to these terms or your use of the platform shall not exceed the total fees paid by you in the 12 months preceding the claim.
Where access to the platform is provided to you at no cost — including where your institution has provisioned your account — our maximum aggregate liability to you is limited to the fullest extent permitted by law, and we accept no liability beyond the exclusions in Section 8.3.

8.3 What We Remain Liable For

Nothing in these terms limits our liability for:
  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Anything that UK law says we cannot limit

9. Data Protection and Security

9.1 Our Commitments

We commit to:
  • Encrypting your data in transit (HTTPS) and at rest
  • Storing data securely with access controls
  • Hosting data in UK/EU data centres
  • Complying with UK GDPR
  • Notifying you of significant data breaches

9.2 Your Responsibilities

You should:
  • Keep your account credentials secure
  • Not share sensitive personal data unnecessarily
  • Report any suspected security issues to security@modalitylearning.ai

9.3 Third-Party Services

We use the following third-party services to operate Modality Learning:
Infrastructure & Hosting:
  • Vercel - Platform hosting and content delivery (data stored in UK/EU region)
  • Firebase (Google) - Authentication, database, and file storage (data stored in UK/EU region)
  • Google Cloud - Document processing and infrastructure (UK/EU region)
Authentication:
  • Firebase Authentication (Google) - Secure account management
  • Google OAuth - Optional sign-in method (subject to Google's privacy policy)
AI & Learning:
  • Vercel AI Gateway - AI model routing and management for Anthropic, OpenAI, and Google models
  • OpenAI - AI-powered tutoring and content generation
  • Anthropic (Claude) - AI-powered content generation and analysis
  • Google AI - AI model services
  • ElevenLabs - Text-to-speech for accessibility features
Analytics & Monitoring:
  • Supabase - Analytics database (with your consent)
  • Google Analytics - Usage analytics (with your consent)
  • Sentry - Error tracking and platform reliability monitoring
Communications:
  • Resend - Transactional emails (invites, notifications)
Each service processes data in accordance with their privacy policies and our Data Processing Agreements. For more details, see our Cookie Policy and Privacy Notice.

10. Changes and Communication

10.1 Changes to These Terms

We may update these terms from time to time. If we make significant changes:
  • We'll email you at your registered address
  • We'll update the "Last Updated" date at the top
  • We'll give you at least 14 days' notice before material changes take effect
  • Continued use after the notice period means you accept the updated terms

10.2 How We'll Contact You

We may contact you via email for:
  • Important service updates
  • Security or privacy notifications
  • Account-related communications
You can opt out of non-essential communications.

11. Termination

11.1 Termination by You

If you created your own account, you can stop using the platform at any time:
  1. Email support@modalitylearning.ai with subject "Close My Account"
  2. We'll confirm within 5 working days
  3. Your account will be deactivated
If your account was provisioned by your institution, contact your institution to request de-provisioning.

11.2 Termination by Us

We may terminate or suspend your account if:
  • You breach these Terms and Conditions
  • We are required to do so by law
  • We discontinue the service (with at least 30 days' notice)

11.3 Termination by Your Institution

If your account was provisioned by your institution:
  • Your institution may de-provision your account at any time — for example, when you leave the institution or are no longer enrolled in a relevant course
  • De-provisioning is managed through your institution's identity provider and may happen automatically
  • Once de-provisioned, you will no longer be able to access the platform through your institutional account

11.4 What Happens to Your Data

When your account is terminated or de-provisioned, you can choose:
  • Delete everything - we'll delete all your personal data within 30 days
  • Keep anonymised data for research - we'll remove identifying information but use anonymised learning patterns to improve the platform
Whatever you choose, we'll confirm in writing. If your account is de-provisioned and you do not contact us, we will delete your personal data within 90 days of de-provisioning.

11.5 Service Discontinuation

If we discontinue the service, we will:
  • Give you at least 30 days' notice
  • Explain what happens to your data
  • Offer you the option to export your learning progress
  • Delete accounts and data within 90 days of discontinuation (unless you opt into continued storage)

12. Feedback and Research

12.1 Providing Feedback

We welcome feedback:
  • Bug reports
  • Feature suggestions
  • Usability observations
  • Learning experience reflections
By providing feedback, you grant us the right to use it to improve Modality Learning without any obligation to you.

12.2 Research

  • Your anonymised interaction data may be used in research to improve learning methods
  • Results may be published in academic papers or presentations
  • You will never be personally identified in publications
  • You can opt out of research use (email research@modalitylearning.ai)

13. Legal

13.1 Entire Agreement

These terms, together with our Privacy Notice, constitute the entire agreement between you and Modality Learning Ltd regarding Modality Learning.

13.2 Governing Law

These terms are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13.3 Severability

If any part of these terms is found to be unenforceable, the rest remains in effect.

13.4 No Waiver

Our failure to enforce any provision doesn't waive our right to enforce it later.

13.5 Assignment

  • You cannot transfer your rights under these terms
  • We may assign our rights to successors or affiliated companies

15. Acknowledgment

By clicking "Accept and Continue" or using Modality Learning (including through an institutionally provisioned account), you acknowledge that:
  • You have read and understood these Terms and Conditions
  • You consent to the data collection and processing described
  • You understand there are no guarantees of learning outcomes
  • You can close your account at any time (or request de-provisioning through your institution)

These terms are effective as of the date stated above and apply to all users of Modality Learning.
